Blog post gone wrong.

A few days ago I posted a photo story about an LTP rally in Yerevan. A few readers commented about the author's biased coverage of LTP and the owner of the pictures required that either the pictures are removed or I disallow any criticism of his work. At first I decided to retain the pictures and censor the comments. But I think that was the wrong decision (the freedom of speech is more dear to me than a post with fancy pictures) so now I have removed the pictures and any reference to the copyrighted material.

Show of force.

[Website...]has posted a few photographs from Levon Ter-Petrossian's rally yesterday. The LTP campaign had a meeting at the Liberty Square and then marched to the Republic Square.

Normally, this would not be a big deal if there was no warning from the Yerevan Municipality about prohibiting any demonstrations or marches by the opposition. By marching LTP wanted to show that the campaign will not be intimidated by such warnings. Surprisingly, the police did not interfere with their brutal suppression as they usually do in such cases.

It was not only the police who kept a close eye. A KGB operative (bottom right) films the participants.

Update: According to the LTP campaign, the Yerevan Municipality was notified and the rally was sanctioned under the Armenian law.

Nazarian jan,
It is strange why you rely on what Onnik writes in his blog. At least part of it is not true, to say the least.

E.g. the "prohibition": he develops a whole theory behind this, questioning why the Police did not interfere...

While the truth is that the Mayor's Office only requested, recommended to abstain from holding rallies, and naturally opposition declared that the Mayor's office exceeded its rights stipulated by the law.

Moreover, the march was "Taken into consideration", in other words, the Mayor's office was properly informed about the march, which means there was NO BREACH. :)

Next time, please, check the Armenian news with us, and don't rely on Onnik.

PS: I hope you don't believe that I have stolen his photos! LOL :))))))))

Aramazd, I did not think the photos were stolen since after reading the license on Flickr, posting them and giving credit was what was required which you guys had done.

But to complicate the matter, he had the posting conditions in a blog post (he required his agreement if the pics were to be posted in places besides blogs) which were not on Flickr so this can be attributed to a 'miscommunication' and 'misunderstanding' category. A copyright is the most valuable (and perhaps the only) asset for someone who generates value that is not material. What I hope is that this controversy has generated publicity to about his work.

His main concern (besides his copyright) was that it would create problems with accessing the other candidates and I understand his concerns given the current conditions in Armenia.

Onnik clearly wrote that any non-profit org can use his photos if credit is provided. This is clearly states that there was no breach of copyright. If he changed the terms on a later date he should have specified clearly and not through accusations.
Also I had the feling lately that he does an anti-Levon campaign hence his too much coverage on LTP. What was that audio slide show about? Why hasnt one done for other candidates, or what is about the peoples opinion stateing that they will not vote Levon. I havent seen one on other candidates lately.
My point is that Onnik's blog can't be taken as an impartial news source anymore.

Aramazd is actually wrong about the march. The law clearly states that it is prohibited.

3. It is prohibited [if]

6) the rally may result in disruption of traffic in the mentioned area or at interstate highways,


As for the use of photographs, as there had been already one instance of copyright infringement raised with Aramazd he knows full well that he should not have used them.

As for anti-LTP bias, no, I am saying it how it is. That I am not pro-LTP means therefore I am anti-LTP.

Regarding your use of my photos you may only use them if I allow you to according to the terms of my CC license.

Attribution. You must attribute the work in the manner specified by the author or licensor (but not in any way that suggests that they endorse you or your use of the work).

I am tired of Aramazd and his people taking my photos, using them without asking about if they can or how to attribute them, and then wondering why I get pissed when they take them without complying with my CC license or copyright.

It's very simple. I also request that you prevent this dispute from spilling over onto your blog or I will contact blogger if my photos are used without my agreement on attribution.

The key is here with regards to how I want my photos to be attributed, and more than that, the fact that I had already contacted Aramazd about one breach and he should have therefore contacted me about use of other images.

Anyway, if you now allow this crap to continue on your blog I will immediately make a request to Blogger to suspend your blog. Basically, here's the deal according to my CC license.

You MAY NOT use my images on any page that allows readers to attack me, accuse me of whatever they want. You don't have to remove these images now, they may stay, but any other criticism of me will mean you must remove every single image and may not use them again.

That's it. Up to you. You can use my images, but use them and allow attacks on me and I will make sure your blog is suspended for violation of the way in which I want my images to be used with reference to my name.

Or, I can actually change my CC now, and remove the right for you to use them at all. It's up to you.

Who says he's a KGB operative? He's just a dude who was there with a video camera and who knows who he is?

One of LTP's people? How do you know he's KGB?

Since this post is a story where the two pictures are an integral part, I will remove any comment that goes against the wishes of the copyright holder. Otherwise it would mean taking down the pictures and losing the story all together.

I will refrain from using any of Onnik's pictures until the passions die down after the elections.

Nazarian, you are perfectly able to use the photos seeing as you are an individual without any financing for producing this website and because you have used my photos before without me raising the issue of copyright. Moreover you are not an official campaign team so the use of them does not appear to endorse you and more than that, you put a link in to my Flickr page (I think, although I didn't actually click the link).

All I'm saying is if you're going to use them at least have the decency to stop people attacking me on the same page, or I would say your blog in general, but that's up to you and an issue of general blogging etiquette and common decency.

Հոդված 13. ԶԱՆԳՎԱԾԱՅԻՆ ՀՐԱՊԱՐԱԿԱՅԻՆ ՄԻՋՈՑԱՌՄԱՆ ԱՆՑԿԱՑՄԱՆ ԱՐԳԵԼՈՒՄԸ



1. Իրազեկման քննարկման արդյունքում լիազոր մարմնի` 12-րդ հոդվածում սահմանված կարգով ընդունված որոշմամբ զանգվածային հրապարակային միջոցառումը կարող է արգելվել միայն այն դեպքերում, եթե`

1) թերությունների մասին զգուշացվելուց հետո իրազեկման հետ չեն ներկայացվել սույն օրենքի 11-րդ հոդվածով նախատեսված բոլոր փաստաթղթերը, կամ բացակայում է պարտադիր որևէ տվյալ.

2) նշված օրը, ժամին և նշված վայրում անցկացվելու է մեկ այլ զանգվածային հրապարակային միջոցառում, որը բացառում է տվյալ միջոցառման անցկացումը կամ նշված օրը, ժամին և նշված վայրում անցկացվելու է ոչ զանգվածային հրապարակային միջոցառում կամ այլ միջոցառում, որոնց վերաբերյալ սույն օրենքով սահմանված կարգով տրվել է իրազեկում, և որը բացառում է տվյալ միջոցառման անցկացումը.

3) առկա են հավաստի տվյալներ, որ նշված օրը, ժամին և նշված վայրում միջոցառման անցկացումն իրական (ռեալ) վտանգ է սպառնում անձանց կյանքին կամ առողջությանը.

4) նշված վայրում սույն օրենքով արգելված է անցկացնել զանգվածային հրապարակային միջոցառում.

5) բոլոր կազմակերպիչները, սույն օրենքի համաձայն, իրավունք չունեն կազմակերպելու զանգվածային հրապարակային միջոցառում.

6) (6-րդ կետն ուժը կորցրել է 04.10.05 ՀՕ-183-Ն).

7) (7-րդ կետն ուժը կորցրել է 04.10.05 ՀՕ-183-Ն).

8) (8-րդ կետն ուժը կորցրել է 04.10.05 ՀՕ-183-Ն):

Երթը կարող է արգելվել, եթե դրա տևողությունն այնքան մեծ է, որ կհանգեցնի այլ անձանց իրավունքների և ազատությունների ոչ ողջամիտ սահմանափակմանը:

2. Զանգվածային հրապարակային միջոցառման անցկացումն արգելելու մասին որոշման մեջ պետք է հիմնավոր և հստակ շարադրվեն զանգվածային հրապարակային միջոցառման անցկացման արգելման պատճառները:

3. Զանգվածային հրապարակային միջոցառման անցկացումն արգելելու մասին որոշումը կարող է բողոքարկվել դատարան: Դատարանը վճիռ է կայացնում 24 ժամվա ընթացքում: Զանգվածային հրապարակային միջոցառման անցկացումն արգելելու մասին որոշումն անվավեր ճանաչելու մասին դատարանի վճիռն ուժի մեջ է մտնում հրապարակման պահից:

4. Եթե իրազեկման քննարկման ժամանակ լիազոր մարմինը գտնում է, որ առկա է սույն հոդվածի 1-ին մասի 2-րդ և 3-րդ կետերով կամ վերջին պարբերությամբ նախատեսված զանգվածային հրապարակային միջոցառման անցկացումն արգելելու հիմք, ապա լիազոր մարմինը պարտավոր է կազմակերպչին առաջարկել զանգվածային հրապարակային միջոցառման անցկացման այլ օրեր (իրազեկման մեջ նշված վայրում և ժամին) և այլ ժամեր (իրազեկման մեջ նշված վայրում և օրը) կամ միջոցառման ձևին վերաբերող այլ պայմաններ (իրազեկման մեջ նշված վայրում և ժամին):

Լիազոր մարմնի կողմից առաջարկվող այլ օրը պետք է լինի կազմակերպիչների կողմից առաջարկվող օրվան հաջորդող երկու օրվա ընթացքում:

Լիազոր մարմնի կողմից առաջարկվող այլ օրվա ժամը պետք է համընկնի կազմակերպիչների առաջարկած ժամին կամ կարող է ունենալ մինչև երեք ժամվա տարբերություն:

5. Եթե իրազեկման քննարկման ժամանակ լիազոր մարմինը գտնում է, որ առկա է սույն հոդվածի 1-ին մասի 4-րդ կետով նախատեսված զանգվածային հրապարակային միջոցառման անցկացումն արգելելու հիմք, ապա լիազոր մարմինը, պարտավոր է կազմակերպչին առաջարկել զանգվածային հրապարակային միջոցառման անցկացման այլ վայր (իրազեկման մեջ նշված օրը և ժամին):

Լիազոր մարմնի կողմից առաջարկվող այլ վայրը պետք է բավարարի կազմակերպիչների ներկայացրած ողջամիտ պահանջները, մասնավորապես, պետք է ապահովի համապատասխան քանակի մասնակիցների մասնակցության հնարավորությունը, եթե մասնակիցների քանակի մասին իրազեկման մեջ առկա է տեղեկատվություն: Չպետք է առաջարկվեն կազմակերպիչների ընտրած համայնքի տարածքից դուրս, Երևանում` առաջարկված թաղային համայնքի տարածքից դուրս վայրեր: Առաջարկվող վայրը հնարավորինս պետք է մոտ լինի իրազեկման մեջ նշված վայրին:

6. Լիազոր մարմնի և կազմակերպիչների փոխադարձ համաձայնության դեպքում կարող է զանգվածային հրապարակային միջոցառման համար ընտրվել ցանկացած այլ օր, ժամ կամ վայր:

7. Սույն հոդվածի 4-6-րդ մասերով նախատեսված` լիազոր մարմնի առաջարկներից մեկը կազմակերպիչների կողմից ընդունվելու դեպքում այդ մասին լիազոր մարմինը և կազմակերպիչները կազմում են արձանագրություն, որը կազմակերպիչներին հիմք է տալիս անցկացնելու զանգվածային հրապարակային միջոցառումը:

Streets belong to people not to the State. If 10 or 100 or 1000 people decide to get together and walk on the streets they should be able to do so. The only permission that they would need is from people.
The current regime does not represent the people so it is illegitimate. Therefore any law produced by it is illegal and should be broken.


On the other hand it is a fact that it is the police that causes trouble than people. This is not only in Armenia but everywhere.

Fortunatly there were no police this time otherwise they would spoil the whole march.

Since I did not want to censor anyone, I removed the pictures. Also, if you notice, I have left all the comments so that there is nothing missing.

Well, if you want to allow comments and personal attacks which violate standard blogging etiquette then fine, you made your choice. There was no attempt at censorship.

This is especially the case as you have my second comment about you not needing to take them down unless you allow future attacks.

I can only suppose that you instead intend to allow them which will lead me to complain to blogger if that is the case.

With or without the pictures, if you allow this blog to be used to attack anyone disseminating information LTP's campaign team don't want, I will have to do that for sure.

Meanwhile, are you actually going to respond to my question as to how you know the guy with the camera who was actually walking with Ter-Petrossian's people is KGB? Just a hunch?

I mean, it's not possible even to see his face in the picture.

Onnik, you probably haven't been under KGB surveillance so here is a crash course on spotting them.

At every meeting or rally, try to locate men with camcorders that film the event even though they do not seem to belong there. They may be among the participants but usually are on the fringes of the groups of people. They are fond of filming the participants and not the orators. They will try to film the faces of people so they film back and forth in order to capture the maximum number of faces.

These can be KGB personnel but a lot of the times are informants - criminal elements that have a deal with them to stay out of jail. That's why they usually seem out of place.

Next time when you are in an opposition rally (LTP, Vazgen Manukian or Artur Baghdasarian), look for these types but try not to attract attention to yourself since it can be hazardous for your health.

Nazarian, your explanation is not good enough as on that basis, most film crews, photographers and journalists could then be described by you and LTP supporters as KGB when it suits them. There was bunch of us that ran ahead to the mound in the middle of Sakharov Square. It's quite simple.

Aramazd, you started the victimization on this thread and what punishment do you propose I wonder? I know you guys like banning political parties and closing down media outlets, but what did you have in mind?

A beating like some of your guys gave to a dissenting voice in Talinn?

As for letters to Embassies, pray tell? What letters have I written? If you're saying that I have then give me details because I can categorically state I have not written one letter to an Embassy since the one I wrote actually expressing my concern about the confiscation of Ter-Petrossian leaflets.

Now, tell me please, what letters?

You gotta have a little experience with those guys to spot them. There was a series of pictures of these guys at earlier opposition meetings in one of the journalists in Armenia (I think living in exile in France now) but I can't find it now. It illustrated visually what I tried to explain with words but you know what they say;

A picture is worth a thousand words.

Sorry, not enough for me to work out any connection between the guy filming and the link you posted to. Hair could be the same, but hard to tell. Anyway, different coat and different video camera. I don't doubt that NSS have their people at rallies, and probably within Ter-Petrossian's campaign team as well, but I don't see enough evidence to caption a photo of an impossible to recognize cameraman and state he is KGB, especially as he came from among the crowd and was not separate. Anyway, next time I'll ask.
